Evergreen Property is pleased to have supported the Judicial Review and is happy the Lord Braid has ruled in the petitioners’ favour stating that Edinburgh Council’s Licensing scheme is unlawful at Common Law, in respect to:
- The presumption of rebuttal for properties within tenements
- the lack of provision of temporary licences
- requirement to supply floor coverings
The Court also found the policy breaches the Provision of Services Regulations 2009 regulations.
Whilst we get to grips what this means for us at the coal face, Evergreen Property thanks and congratulates the petitioners who were brave enough to challenge the Council and we also give thanks to the landlords who donated to this worthy and just cause.
